AIG-NYRC offers protections for investors to mitigate risks associated with Regional Center Program Reauthorization

American Immigration Group-NYRC, LLC (“AIG-NYRC”) a leading EB5 Regional Center, headquartered in New York, NY today announced that in order to mitigate some of the risk associated with the reauthorization of the Regional Center Program set to occur on 30 June 2021, the Company and the Managing Member have decided that they will not cause the Escrow Agent for neither Banyan Cay Hyatt Resort or the Kingsbridge National Ice Center projects, to release any subscriber’s Subscription Amount or Administrative Fee from the Escrow Account until the Regional Center Program has been reauthorized, even if all conditions for the release have been satisfied.

During this time the investors can submit their I-526 application to USCIS since there is high probability that the existing I-526 applications will be grandfathered and continue to be processed even if the program itself is not reauthorized.

“We developed this option in response to the concerns we have received from our agents and potential investors alike, about the possibility of the EB-5 Program not being Reauthorized by 30 June 2021, but also to create a safe option for our investors to comfortably submit their I-526 petition and not miss out on the opportunity of getting their EB-5 visa in case the program does not get reauthorized, but the existing petitions are grandfathered in the current program,” said David Finkelstein the CEO of American Immigration Group-NYC.

In the highly unlikely case that the program does not get reauthorized and existing petitions are not grandfathered into the current program, AIG-NYRC will return all the funds to their investors.

In case the program is not reauthorized but existing I-526 petitions are grandfathered in, the investors can continue with their EB-5 process.

In case the reauthorization is postponed for a later date, the investors will have the option to either withdraw and get their funds back or continue with the process.

Qendrese Sadriu-Rrustemi, the Managing Director for American Immigration Group-NYRC said; “We are hopeful that the EB-5 program will be reauthorized, however, our priority has always been to protect the investors and agents who place their trust on us and our projects and as such we have taken measures to ensure that our investors do not face any risks in the unlikely scenario of the program not being reauthorized.”
